Regulatory and legal support of construction _in the focus of the law of Ukraine “on the making of construction products on the market”

Abstract

The article is devoted to a comprehensive analysis of the regulatory and legal support of the construction industry of Ukraine in the context of the implementation of the Law of Ukraine “On the Making of Construction Products on the Market”, harmonized with EU Regulation No. 305/2011 (CPR). The paper examines the structural changes that have occurred in the system of technical regulation and quality control of construction products, and also substantiates their impact on design practice, the organization of construction production and the overall quality of construction project implementation. It is shown that the implementation of the European principles of assessment and verification of stability of operational characteristics (AVCP) has provided a new level of verifiability, traceability and responsibility at all stages of the circulation of construction products - from the manufacturer to the end user.Particular attention is paid to the analysis of how the law affected the quality of construction: removing materials without confirmed characteristics from the market, increasing the transparency of technical information, forming predictability of technological solutions and reducing the risks of using low-quality or counterfeit products. Standardization of technical documentation and the introduction of requirements for declarations of characteristics contributed to increasing the accuracy of design solutions, optimizing calculation systems and ensuring a higher level of compliance of constructed structures with the requirements of reliability and durability.The article also reveals that the law significantly transformed the organization of construction and design, contributing to the streamlining of logistics processes, optimizing supply chains, the formation of new management approaches in contracting organizations and strengthening technological discipline. The introduction of mandatory traceability of product batches and increased responsibility of manufacturers and importers led to the modernization of resource supply systems, an increase in the level of control at construction sites and a reduction in uncertainty when making engineering decisions.Summarizing the results of the study, the authors conclude that the Law "On the Provision of Construction Products on the Market" is a significant step in the development of the national construction industry, as it creates conditions for its structural renewal, integration into the European space, improving the quality of construction and forming an effective system for organizing construction processes in the post-war period.
